Subterranean Termite and Carpenter Ant Treatment Agreement

Terms and Condition
Enrollment in the program requires a current “clear” WDI (Wood Destroying Insect) report, a signed copy of this service agreement along with the $99.00 (plus tax) annual fee. A WDI report is not required for new construction or homes which are less than one year of age.

If the customer does not have a current “clear” WDI report and one is needed, a WDI report can be arranged for a cost of $65.00 plus applicable state sales tax.

This treatment agreement covers only the primary dwelling. Sheds, detached garages, lean-tos, fences, guest houses or any other structure will not be included in this service agreement unless specifically agreed to in writing by both parties. These types of structures are subject to the same type WDI report as the primary dwelling and additional fees will be required.

The service agreement will automatically renew and your credit card will be billed for 99.00 plus sales tax on the anniversary date of the original agreement. Any lapse in coverage may require an additional WDI report to reinstate the agreement.

Customer can request inspections of the property listed below as often as they deem necessary for a $49.00 service fee. Customer agrees to make available access to all areas of the structure (interior and exterior) for inspection. If active subterranean termite or carpenter ant infestations are detected, the service fee will be waived and treatment of the effected areas will be performed at that time.

The customer can “opt out” of the agreement at any time by notifying THS in writing, and a refund of the unused portion of the annual fees will be refunded on a pro-rated basis.

If subterranean termites or carpenter ants are found at the address listed in this service agreement, THS, through one of its authorized pest control professionals, shall arrange to have the effected area(s) treated in a manner deemed appropriate by the certified applicator to eliminate the infestation at no cost to the customer. Due to the nature and additional difficulty in treating pier and beam construction, a $150.00 co-payment will be due and payable at the time the treatment is performed.

If the customer desires a more extensive treatment than what is deemed necessary by the certified applicator, the customer agrees to pay the full amount for the more extensive treatment and THS will arrange to discount the treatment cost by $200.00.

THS will not pay for the cost of treatment by any pest control company other than an authorized representative of THS.

Customer agrees to make the listed property accessible to a THS representative for any inspections and treatments as THS or its authorized pest control operators deem necessary. This may include removing floor coverings, wall coverings, and fixtures, for which the cost rests exclusively with the customer. If the customer fails to comply with these obligations, THS, may, at its option, terminate the agreement, and refund any unused portion of the annual fees.

The customer agrees to be solely responsible for maintaining the premises free from any condition conducive to subterranean termite and carpenter ant infestation. The customer also agrees to be solely responsible for the identification and correction of any conducive conditions. In addition, the existence of any conducive condition, that was not timely corrected, including any conducive condition existing, but not visible at the time of the execution of this agreement, will permit THS, at its sole discretion, to terminate the agreement or to require the customer to purchase any additional treatment required as a result of the conducive condition.

Conducive conditions include, but are not limited to: roof leaks, improper ventilation, faulty plumbing, and water leaks or intrusions in and around the structure; inherent structurally problems, including but not limited to, wood to ground contact, masonry failures, and settlement of the foundation: foam insulation, stucco construction, expanded polystyrene or Styrofoam molded foundation systems, siding (including vinyl, wood and metal) in contact with the ground, soil levels above the brick ledge, mulch or other protective ground covering: and firewood, trash, lumber, wood, mulch, shrubs, vines, and other protective ground covering in contact with the structure.

OTHER INFESTATIONS
This service agreement is for the treatment of subterranean termites and carpenter ants only. The Customer waives and releases THS or its representatives from any liability for any claim for damages to the structure or its contents caused by an infestation of Wood Destroying Fungi, Formosan Termites, Drywood Termites, Wood Boring Beetles, or any other Wood destroying insects.

LIMITATION OF LIABILITY
By my signature, I agree that TEXAS HOME SHIELD will not be held responsible for any structural or cosmetic damage caused by the presence or infestation of subterranean termites, carpenter ants or any other wood destroying insects or fungi, or any treatment methods employed by the treating company. I understand that THS is only the provider or contractor of treatment services. Individual pest control operators contracted by THS are subject to the laws, regulations, licensing, and insurance requirements of the Texas Structural Pest Control Board, and are individually responsible for their own methods of treatment and applicable treatment guarantees.

MONEY BACK GUARANTEE
TEXAS HOME SHIELD guarantees that if for any reason, the customer is not completely satisfied with the implementation or terms of this service agreement, THS will refund any fees paid by the customer without question.
